Customs broker — role and limits
A licensed or registered intermediary who files declarations for the importer, but does not automatically take on the duty liability.
Key facts
| Core job | Classify, value, file and respond to customs requests for the importer |
|---|---|
| Authority | Usually needs a power of attorney or written authorisation from the importer |
| Liability | The importer of record normally remains liable for duty, tax and penalties |
| Licensing | Some countries license individual brokers; others regulate customs representatives at company level |
| Fees | Per entry, per shipment, plus disbursements and examination costs |
| Not the same as a forwarder | A freight forwarder moves cargo; a broker files the customs declaration, though one company may do both |
| Official source | National customs authority licensing rules |
A broker is not a compliance guarantee
Brokers file what the importer gives them. If the product description is vague or the value is understated, the broker may file it and the importer still carries the risk. Good brokers ask questions; weak ones only key in the data.
Ask who reviews the tariff code, who keeps the ruling evidence and who pays if an adjustment is issued. Put the answer in the service agreement, not in a phone call.
When to use one
Use a broker for commercial imports, repeated entries, bonded movements and anything involving a permit or a special procedure. For a one-off low-value parcel, the carrier may clear it under a simplified procedure, but the importer is still responsible for accuracy.
If you sell into several countries, prefer a broker with a local office or a verified partner network. Clearance problems are local, and a call centre in another time zone rarely resolves a port hold.
Frequently asked questions
Is a customs broker liable if the duty is wrong?
Usually the importer of record remains liable. The broker may have contractual responsibility for its own filing errors, so read the service terms.
Can a freight forwarder clear customs?
Many forwarders employ or partner with brokers. Confirm that a licensed or registered representative actually files the entry.
