Copyright and trademark risk in POD

Using characters, logos, slogans or artwork without permission can trigger takedowns, account suspension or legal claims.

Key facts

CopyrightProtects original artwork, text and characters
TrademarkProtects brand names, logos and some slogans
Fan artNot automatically permitted; it depends on the rights holder and platform policy
Public domainWorks whose rights have expired can be used, but check the jurisdiction
LicensingA license can permit commercial use, usually with terms and royalties
Platform reviewAutomated and manual checks can remove listings
Official sourceThe platform's IP policy and the relevant IP office

A takedown is a business interruption

A single claim can remove a listing, freeze a store or escalate to a legal demand. The fact that a design was accepted by the provider does not mean it is licensed.

Keep the source of every design: original work, a license, a public-domain source or a commissioned artist's assignment. If you cannot show the source, do not scale the design.

AI-generated art still needs a rights check

AI tools can produce an image, but that does not automatically clear copyright, trademark or likeness issues. Platform policies on AI-generated content also vary.

Treat AI output like any other design: check the subject, the style, the text and any recognizable brand or person before selling it.

Frequently asked questions

Can I sell fan art on print on demand?

Only if you have permission or the platform and rights holder allow it. Most fan art using protected characters is not licensed by default.

Is public-domain art safe to use?

Usually, but check the jurisdiction and the source. A photograph of a public-domain painting may have its own rights.
